1. Acceptance of Terms

By accessing or using the WingZen platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

WingZen provides a marketplace connecting customers seeking private aviation charter services with licensed aircraft operators. We facilitate bookings but do not operate aircraft ourselves.

2. User Accounts

2.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2.3 Account Types

WingZen offers two types of user accounts: Customer accounts for booking flights, and Operator accounts for listing aircraft and accepting bookings. Different terms may apply to each account type.

3. Booking and Payments

3.1 Booking Process

Customers may submit booking requests through the platform. Operators have the right to accept or decline booking requests at their discretion. A booking is confirmed only after the operator accepts and payment is processed.

3.2 Pricing

Aircraft pricing is set by operators. WingZen charges a platform fee on each transaction. All fees will be clearly disclosed before payment.

3.3 Payment Processing

Payments are processed through our third-party payment processor, Stripe. By using our Service, you agree to Stripe's terms of service.

3.4 Cancellations and Refunds

Before Booking Confirmation: If you cancel before the operator confirms your booking (or before you accept a proposed alternative time), your card will not be charged. The authorization hold will be released automatically.

After Booking Confirmation: Once both parties have agreed and your payment has been processed, the following cancellation tiers apply:

  • More than 48 hours before scheduled departure: 89% refund of the total booking cost.
  • 24 to 48 hours before scheduled departure: 50% refund of the total booking cost.
  • Less than 24 hours before scheduled departure: No refund.

Refunds are processed via the original payment method and typically appear within 5-10 business days.

Operator Cancellations: If the operator cancels a confirmed booking, you will receive a full 100% refund regardless of timing.

4. Operator Requirements

Operators using the platform must:

  • Hold all required licenses, certifications, and insurance for commercial aviation operations
  • Maintain aircraft in accordance with all applicable regulations
  • Provide accurate information about aircraft capabilities and availability
  • Complete WingZen's verification process
  • Respond to booking requests within the specified timeframe
  • Comply with all applicable aviation laws and regulations

WingZen reserves the right to verify operator credentials and remove operators who do not meet our standards.

5. Customer Responsibilities

Customers using the platform must:

  • Provide accurate passenger information
  • Comply with all operator and aviation security requirements
  • Arrive at the designated location at the specified time
  • Follow all safety instructions provided by the operator
  • Ensure all passengers have required travel documents
  • Not engage in any illegal activities during flights

6. Limitation of Liability

WingZen is a marketplace platform and does not operate aircraft. We are not responsible for:

  • The quality, safety, or legality of flights operated by third-party operators
  • Flight delays, cancellations, or diversions
  • Loss, damage, or injury during flights
  • Operator failure to perform services

To the maximum extent permitted by law, WingZen's liability is limited to the platform fees collected for the affected transaction.

7. Dispute Resolution

In the event of a dispute between customers and operators, WingZen may, at its discretion, assist in mediating the dispute. However, WingZen is not obligated to resolve disputes and the final resolution remains between the parties involved.

Users may submit disputes through the platform within 7 days of the scheduled flight date.

8. Intellectual Property

The WingZen platform, including its design, features, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the modified Terms.
